The Bombay High Court on Wednesday said that the granule to pigeons creates public nuisance and also threatens people’s health. The High Court directed the Mumbai Municipal Corporation to register an FIR against those involved in such activities.

A bench of Justice GS Kulkarni and Justice Arif Doctor heard a petition filed by a group of animal lovers. During this time, the High Court said that the issue is related to public health and there is a serious and potential threat to the health of people of all ages.

The court prevented BMC from demolishing pigeon

The court had prevented the Brihanmumbai Municipal Corporation (BMC) from demolishing any old heritage ‘pigeonkhans’ in the metropolis earlier this month, but said that it could not allow these birds to enter the grain. The court said on Wednesday that despite not getting permission, people are continuing to pour pigeons in these ‘pigeonkhans’.

The court directed BMC to punish people who put grain

The bench said that the situation has now become even more complicated by the emerging situation of the gross disregard of the law, as in our earlier order, the petitions were dismissed by the petitions and supporting their gathering. Now the municipal officials are being prevented from discharging their duties in this regard. After this, the High Court directed the BMC to punish the pigeons and punish the pigeons.

The High Court said, “We allow the Municipal Corporation to prosecute against any person/persons who disregard the instructions issued by MCGM (Metropolitan Corporation) and continue to put pigeons, because in our clear opinion, such acts will cause public disturbance and can spread diseases and can spread diseases and puts diseases and endanger human life.”

Municipal corporation will take all necessary steps

The bench said that the Municipal Corporation will take all necessary steps to prevent the gathering of pigeons in various ‘pigeonkhans’ of the metropolis and apply strict measures as it is appropriate. The court said that today’s main concern is again the most important aspect- that is, the protection of human health due to the threat from the gathering of pigeons in the concerned pigeons.

The court was hearing the petition of animal lover Pallavi Patil, Sneha Visaria and Savita Mahajan, who claimed that BMC started demolishing ‘pigeonkhans’ from July 3 without any legal basis. He argued that BMC’s act violates the Animal Cruelty Prevention Act.
