Another case has been registered on Wednesday afternoon against both the builders in connection with the death of engineer Yuvraj in Sector 150. Police have filed a case against Lotus Green Construction Private Limited and partners of Wish Town in Knowledge Park Kotwali in this case. In this case, a case has been registered against builders Abhay Kumar, Manoj Kumar, Sanjay Kumar, Achal Vohra and Nirmal under the Environment Protection and Water Pollution Prevention Act.

According to the complaint given by Sub Inspector Regal Kumar, during patrolling and checking on January 20, when he reached the spot, he found that very close to the public road, there was a very long and deep pit made by digging with heavy machines. This pit has been filled with water for many years, which has now become completely polluted and has become like mud. The garbage flowing from the surrounding areas during the rainy season also gets accumulated in this waterlogging, due to which foul smell and poisonous gases are spreading in the atmosphere.

Neither any barricading nor any kind of warning signs have been installed around this pit. Having such an open and submerged pit near a public road can cause a serious accident at any time. This can prove fatal for drivers and pedestrians, especially at night or in fog. There are also under construction plots nearby. This also makes it clear that the rules of construction management were not followed.

Local residents told the police that when the wind blows from the opposite direction, the foul smell of the rotten water filled in this pit makes it difficult to even breathe. Due to this, children, elderly and sick people are facing special problems. People fear that the risk of diseases like dengue and malaria may increase due to the proliferation of mosquitoes.

The plot was purchased by LotusGreen Construction Pvt Ltd from Greater Noida Authority in the year 2014. After this, in the year 2020, this land was purchased by Wish Town, but Lotus Green Construction still has a stake in it. The shareholding of the company is said to be 32.20 percent of Abhay Kumar, 27.30 percent of Sanjay Kumar, 7 percent of Manish Kumar, 3.05 percent of Achal Bohra and about 30 percent of Lotus Green including Nirmal Kumar.

Leaving this pit open and submerged for such a long time is not only a violation of Section 15 of the Environment Protection Act 1986 and Sections 24 and 43 of the Water (Prevention and Control of Pollution) Act. Rather, it also falls under the category of crime under sections 290 (public nuisance), 270 (act likely to spread disease) and 125 (negligence endangering human life) of the Indian Justice Code (BNS).

On the complaint of Sub Inspector Regal Kumar, a case has been registered under relevant sections at Knowledge Park Police Station against Abhay Kumar, Sanjay Kumar, Manish Kumar, Achal Bohra and Nirmal Kumar. Police say that the matter is being investigated and it will be found out why those responsible have not taken any steps till now to fill or secure the pit.
